If anyone is a more unsympathetic defendant than Scooter Libby, it is war-mongering, pro-draft Congressman Randy “Duke” Cunningham. However, Cunningham’s prosecutors set a dangerous precedent when they sought to increase Cunningham’s sentence because he issued press releases proclaiming his innocence (registration required for link). The criminalization of defense continues.
