Will Hackers Be Enemies at War?

Which cyber attacks are acts of war and which are not? The U.S. government has laws already on the books that can be used to label hackers as terrorists, spirit them away, or even kill them; but if it interprets cyber attacks as acts of war, then it has even more latitude to view selected hackers as enemies at war and deal with them outside the justice system. Of course, within the “justice” system, it can always expand the use of RICO, seize assets, and find conspiracies under every computer terminal.
