Yay for that blow (how major it may be is another matter)! And yay that a tiny bit of freedom is still left New Yorkers, at least for a while. But this ban was completely, totally tyrannical, not merely “arbitrary and capricious,” as the judge alleges. (And yes, those are synonyms for “tyranny,” though I doubt the gowned clown meant them that way). At any rate, the judge “specifically cited a perceived inequity in the soda rules, which applies to only certain sugared drinks — beverages with a high milk content, for instance, would be exempt — and would apply only to some food establishments, like restaurants, but not others, like convenience stores. ‘It applies to some but not all food establishments in the city,’ Justice [Milton] Tingling wrote. ‘It excludes other beverages that have significantly higher concentrations of sugar sweeteners and/or calories.’”
Presumably, had Nanny imposed his opinion on all sellers of soda everywhere, the judge would have let it stand. Wanna bet the currently “stunned” Nanny Bloom tries that next?
