The Hypocrisy of the States on Obamacare

March 23, 2011

The health care law is one year old today. Some states have sued over the Patient Protection and Affordable Care Act, arguing that the law’s requirement that people buy health insurance violates the Constitution. Now, I believe in federalism, states rights, nullification, the 10th Amendment, and anything the states can do to shrink the power of the federal government. But in just about every state, auto insurance is required by state law. Why isn’t that considered unconstitutional? Yes, I know it would be unconstitutional if the feds required it and states can have such laws. But my point is simply that state governments can be just as tyrannical as the federal government. Most of what the federal government does is unconstitutional, but rarely do we hear a word from the states. The real problem some states have with Obamacare is that they just don’t like it (and neither do I), but the constitutional angle is the best way to oppose it.

(I believe that in the states that don’t require auto insurance, you must must be able to prove that you have the ability to pay for any damages in an accident, which forces most people to purchase auto insurance.)
