A libertarian friend who’s an expert on the natural-born citizen question points out that Cruz is right when he says that Congress passed a law in 1790 saying that Americans born of American parents in foreign countries are to considered natural-born. But Cruz fails to note that Congress repealed that law in 1796. My friend assumes that the courts would rule in Cruz’s savor these days, but the issue has never been adjudicated.
