Dear Walter,
I am not so sure why the government shouldn’t be allowed to do anything at all just because it is doing some criminal things. Suppose you and I open a fruit store and defraud some customers by giving them plastic fruit. Sure, we are a criminal organization and we should be punished for our crime of fraud (say, by monetary compensation). But does that mean, during the period of our fraud, we shouldn’t be allowed to conduct any lawful operation (e.g. selling real fruit to other customers)? I think the answer is in the negative.
In light of this, why can’t the government do non-rights-violating things (e.g. administering the hypothetical scholarship mentioned in my previous email) while we haven’t gotten rid of it and its rights-violating activity? Surely it should be allowed to cease its rights-violating activity and only conduct non-rights-violating activity (and not have to disband). Then, while it is still doing rights-violating things, why can’t it, in addition, do some non-rights-violating things?
By the way, if X is not allowed to leave his money to the government for this purpose, how should his money be treated? Given to his de facto heir?

AFTER you and I are let out of jail for our fraudulent fruit selling, and have paid our full debt, not to “society” but to our victims, then, yes, we should be allowed to go into (honest, this time) business. But you’re asking the private libertarian, police forces to allow us to conduct business BEFORE we’ve been punished? No way. Similarly, the govt is committing crimes on an ongoing basis. Therefore, it should be stopped, and not allowed to continue doing good as well as bad things.
What of the money voluntarily given to the evil govt? Yes, it should be returned not to the donor, who is a criminal, but to his heirs.
Here is a reading list in favor of anarchy: that is, disbanding government, root and branch, not allowing it to continue its “good” acts (from whence does it obtain the funds necessary to do these good acts? From taxes, compulsory levies, that’s wherefrom).
