Only figuratively. “A  judge invalidated New York City’s ban on large sugary drinks on Monday, one day before it was to go into effect, dealing Mayor Michael R. Bloomberg a major blow.” Yay for that blow (how major it may be is another matter)! And yay that a tiny bit of freedom is still left New Yorkers, at least for a while. But this ban was completely, totally tyrannical, not merely “arbitrary and capricious,” as the judge alleges.
