In a recent blog post, I critiqued Timothy Sandefur’s article "Liberty and Union, Now and Forever" (Liberty, July 2002). There Sandefur argued that libertarians should not side with the Confederacy in the War Between the States. The December 2002 Liberty carries Sandefur’s article "Why Secession Was Wrong," his response to the many libertarians who have disagreed with him. Sandefur’s view is that Lincoln had the right to prosecute the Civil War in order to prevent the Southern states from seceding, because the states had no constitutional right to secede.
