Sarbanes-Oxley and Patrick Fitzgerald

I am glad to see someone else (Norman) on this blog who has problems with the heavy-handedness of Patrick Fitzgerald. To be honest, I would prefer Karl Rove and others not to be indicted if it takes the trashing of the Constitution and the destruction of our rights that the Constitution supposedly protects to make the indictment happen. I have received a number of emails in which people say, in effect, that since the bad guys are being indicted and it is hurting Bush, that we should be cheering on federal prosecutors at all costs.

Please remember that people like Fitzgerald do not give a rat’s behind about Constitutional rights. They simply want to “win” by getting convictions, and they will do anything they can. To people like Patrick Fitzgerald and his ilk, the Constitution simply is an impediment that keeps them from gaining convictions. If I have to choose between an indictment of Karl Rove and the First Amendment, I think I will take the First Amendment. For that matter, how in the world can Sarbanes-Oxley even be Constitutional?
