He cited 9/11 as an example of when there was not time for a declaration of war. But the attack was over before the feds were able to effectively respond. Bush then asked Congress for an authorization to respond. The resolution was passed on September 18, 2001. The question of course dealt with a preemptive war against Iran, not an actual attack on the US.
