Kathryn: The unasked question we encounter in all of this is: why should the state be involved with licensing drivers (i.e., certifying who can and who cannot lawfully operate an automobile)? It’s the same issue that is never explored in the gay-marriage debate: why should the state be deciding who can and who cannot be regarded as a married couple – rather than having such matters be determined by contract?
