The Duke non-rape case continues to blow up in the face of the evil prosecutor Mike Nifong. The latest unraveling comes with the DNA “evidence” now demonstrating, as one of the attorneys has noted, that the woman indeed had sex, but with someone else:

“Attorney Joseph Cheshire, who represents a team captain who has not been charged, said the tests showed genetic material from a ’single male source’ was found on a vaginal swab taken from the accuser, but that material did not match any of the players.”

“‘In other words, it appears this woman had sex with a male,’ said Cheshire, who spoke at a news conference with other defense attorneys in the case. ‘It also appears with certainty it wasn’t a Duke lacrosse player.’”

About two weeks ago, I wrote one of the attorneys in the case and told him that I had no doubt that DNA of a non-lacrosse player had been found, but that the prosecution was not revealing that fact. Well, it turns out that I was correct in my educated guess. Moreover, the DNA matches someone who, according to an attorney, is familiar to the Durham Police Department.

The sad fact of this case is that the prosecutor and investigators have known from the start that the woman was lying, but they pursued it anyway for pure political reasons. After falsely telling ABC News and the Durham Herald-Sun that a conclusive DNA match (on a false fingernail) to a player had been found, we now find just how much the DA has been lying.

It is unfortunate that Nifong will not be arrested, tried, and convicted. Instead, given the political atmosphere surrounding this case, he still might succeed in railroading innocent people into prison. In fact, it is highly likely that a third player is going to be indicted next week, according to news reports. This is the state of U.S. law today.
